New startup company will pay for your wedding unless you get divorced

I ran across an interesting article from the Washington Post (click the link in red above). The statistics quoted are most interesting and some of them really surprised me. The question I ponder from this is how the divorce court will handle this debt. Is it pre-marital? If it’s pre-marital, I would recommend both future spouses sign it, to make them each potentially 50% responsible for the loan should it “come due.” Another thought I had is whether this changes “no-fault” divorce. Is there an argument that spouse X is responsible for the break-up our marriage, so he/she should be responsible for the loan? I would love to hear your thoughts…
